Abstract
La investigación titulada: “La limitación de la patria potestad frente al incumplimiento de las obligaciones parentales, en el cantón San Miguel, año 2022” Se concentra en conocer los derechos y obligaciones que se derivan de la patria potestad, mismos que actualmente se determinan en el texto constitucional ecuatoriano como deber de corresponsabilidad parental. Así también fue necesario elaborar un estudio sobre el posible incumplimiento de los derechos y obligaciones que se derivan de la patria potestad por parte de uno o ambos padres, con lo cual quedaría evidenciada la vulneración del deber de corresponsabilidad parental. En estos casos el hijo o hija menor de edad se halla desprotegido del cuidado que generalmente brinda la familia nuclear y queda expuesto a los riesgos y peligros de la sociedad, razón por la cual, el Estado debe brindarle los contingentes necesarios a fin de salvaguardar su integridad, para esto debe iniciar limitando los derechos y obligaciones de uno o ambos padres y confiar el cuidado íntegro del menor a uno solo de ellos o incluso dictando medidas de protección en favor del menor confiando su cuidado temporalmente a un familiar, pero manteniendo ciertas obligaciones al padre limitado como es el caso del derecho de alimentos. La metodología de esta investigación es fenomenológica e interpretativa, con enfoque cualitativo. Se empleó el método interpretativo para el análisis y sistematización de los documentos que sustentan el soporte teórico del presente trabajo, como es la Constitución de la República del Ecuador, el Código Orgánico de la Niñez y la Adolescencia, el Código Civil y los Instrumentos Internacionales que refieren los derechos de la niñez y adolescencia. La investigación fue de alcance descriptivo en cuanto a su profundidad y empírica, pero no experimental en cuanto a la manipulación de las variables. Como investigación pura o teórica, se utilizó el análisis de documentos como técnica de estudio y las encuestas como técnica de recolección de datos. Finalmente, la investigación llegó a las principales conclusiones y recomendaciones.

The research entitled: "The limitation of parental authority in the face of non-compliance with parental obligations in the canton of San Miguel, year 2022" focuses on knowing the rights and obligations derived from parental authority, which are currently determined in the Ecuadorian constitutional text as the duty of parental co-responsibility. It was also necessary to elaborate a study on the possible non-compliance of the rights and obligations derived from parental authority by one or both parents, with which the violation of the duty of parental co-responsibility would be evidenced. In these cases the minor son or daughter is unprotected from the care generally provided by the nuclear family and is exposed to the risks and dangers of society, for which reason, the State must provide the necessary contingencies in order to safeguard their integrity, for this it must begin by limiting the rights and obligations of one or both parents and entrust the full care of the minor to only one of them or even dictating protective measures in favor of the minor entrusting their care temporarily to a relative, but maintaining certain obligations to the limited parent as is the case of the right to food. The methodology of this research is phenomenological and interpretative, with a qualitative approach. The interpretative method was used for the analysis and systematization of the documents that sustain the theoretical support of this work, such as the Constitution of the Republic of Ecuador, the Organic Code of Childhood and Adolescence, the Civil Code and the International Instruments that refer to the rights of children and adolescents. The research was descriptive in depth and empirical in scope, but not experimental in terms of the manipulation of variables. As pure or theoretical research, document analysis was used as a study technique and surveys as a data collection technique. Finally, the research reached the main conclusions and recommendations.
