Resumen :	La tesis que se titula: “La adopción y el cumplimiento del derecho a una familia, Cantón Guaranda, 2022”. Trata el tema de la figura adoptiva que parte del Derecho, y se orienta a solucionar un problema social, que es el abandono de niños, niñas y adolescentes, recordando que los sujetos de la adopción pueden ser aquellos seres humanos de hasta 21 años de edad. No obstante, queda claro que la figura adoptiva se ha creado para proveer un ambiente familiar a un niño o niña, que ha sufrido el abandono de sus padres, bajo el entendimiento que la institución de la familia, es el ente más idóneo para la crianza de los futuros ciudadanos. Por otra parte, el trabajo se enfoca en determinar el alcance del derecho a la familia contemplado en la Constitución de la República del Ecuador y en los Tratados Internacionales, para conocer si la adopción satisface este derecho o si en la práctica se presentan dificultades para su consolidación. En esta forma, el objetivo general de la presente tesis será: Analizar la incidencia que posee la figura adoptiva frente al derecho a tener una familia, en el cantón Guaranda, 2022. La metodología de la investigación es interpretativa, con un enfoque cualitativo propio de las Ciencias Sociales, como el Derecho, y un método interpretativo del análisis y la interpretación (literal, sistemática, técnica e histórica). La investigación fue descriptiva en cuanto a su profundidad y naturaleza empírica, pero no experimental en cuanto al grado de manipulación de las variables. Se empleó el análisis de documentos como método, por lo cual, la investigación es de naturaleza pura o teórica, con el único fin de validar el contenido presentado. Además, se realizaron encuestas dirigidas a especialistas en la materia. En última instancia, el estudio llegó a las conclusiones y sugerencias primarias subsiguientes; así como a las recomendaciones del trabajo.
Descripción :	The thesis is entitled: "Adoption and the fulfillment of the right to a family, Canton Guaranda, 2022". It deals with the subject of the adoptive figure that starts from the Law, and is oriented to solve a social problem, which is the abandonment of children and adolescents, remembering that the subjects of the adoption can be those human beings up to 21 years of age. However, it is clear that the adoptive figure has been created to provide a family environment to a child who has suffered the abandonment of his or her parents, under the understanding that the institution of the family is the most suitable entity for the upbringing of future citizens. On the other hand, the work focuses on determining the scope of the right to a family contemplated in the Constitution of the Republic of Ecuador and in the International Treaties, in order to know if adoption satisfies this right or if in practice there are difficulties for its consolidation. In this way, the general objective of the present thesis will be: To analyze the incidence that has the adoptive figure in front of the right to have a family, in the canton Guaranda, 2022. The research methodology is interpretative, with a qualitative approach typical of the Social Sciences, such as Law, and an interpretative method of analysis and interpretation (literal, systematic, technical and historical). The research was descriptive in terms of its depth and empirical nature, but non-experimental in terms of the degree of manipulation of the variables. Document analysis was used as a method, therefore, the research is of a pure or theoretical nature, with the sole purpose of validating the content presented. In addition, surveys were conducted with specialists in the field. Ultimately, the study arrived at the conclusions and subsequent primary suggestions; as well as the recommendations of the work, this from what was found in the results of the investigation that concentrate on the opposing theories found for the effect.
