Resumen :	En este trabajo de investigación que lo he titulado: “El orden sucesorio y los requisitos que deben cumplir los herederos al momento de la partición de los bienes del causante dentro de la sucesión intestada en el cantón chimbo provincia Bolívar”; realizaré un análisis doctrinario y jurídico del orden sucesorio y todo lo encierra la institución jurídica de la partición de bienes en la sucesión intestada, fortaleciéndola con una investigación de campo que me permitió plasmar ideas objetivas, y conclusiones que sustente la presente investigación. La sucesión surte efecto al momento que la persona fallece, extinguiendo y creando Derechos y obligaciones, es decir, es una forma que los herederos pueden adquirir el dominio o la propiedad de los bienes del causante siendo este a título universal o singular. La sucesión siendo la transmisión de relaciones jurídicas en relación a la herencia, la ley llama a suceder los bienes de la persona fallecida a la persona que sobrevive denominado testador. En Ecuador existen diferentes maneras en que los herederos pueden suceder los bienes del causante la cual se otorga en virtud de un testamento consignando el destino de sus bienes denominado sucesión testamentaria al igual tenemos en virtud de lo que determina la Ley denominado sucesión intestada, y la sucesión mixta en virtud en que los bienes de una persona son por una parte otorgada por testamento y otra parte determinada por la ley, es decir parte testamentaria y parte sucesión intestada. El presente trabajo se basará en la investigación del orden en que los herederos deberán suceder los bienes de la persona fallecida y todos los requisitos que deberán cumplir para la adquisición de los derechos y obligaciones para adquirir el dominio de los bienes dejados, estos bienes podrán otorgarse mediante la sucesión testamentaria o a su vez por medio de lo que determina la ley o la sucesión intestada como lo establece nuestro Código Civil ecuatoriano, tomado en consideración que la presente investigación se realizara basándose en información de libros, revistas, páginas web, documentos y doctrina jurídica en relación al tema planteado. La metodología utilizada en este trabajo de investigación es la cualitativa y cuantitativa, en virtud de que los hechos y fenómenos sociales que estudiaré en este trabajo son medibles y cuantificables; así también medí y establecí relaciones causales entre las variables, para explicar el problema de estudio y la realidad social actual. Apliqué el método dogmático e interpretativo, pues a través de estos métodos se ofrece una respuesta al problema tratado a partir de lo que cree la mejor reconstrucción posible permitida por el material jurídico que se tiene a disposición.
Descripción :	In this research work that I have titled: "The succession order and the requirements that the heirs must meet at the time of the partition of the deceased's assets within the intestate succession in the Canton Chimbo Province of Bolívar"; I will carry out a doctrinal and legal analysis of the succession order and of everything contained in the legal institution of the division of assets in the intestate succession, strengthening it with a field investigation that allowed me to capture objective ideas, and conclusions that support the present investigation. The succession takes effect at the time a person dies, extinguishing and creating rights and obligations, meaning that it is a way in which the heirs can acquire domain or ownership of the assets of the deceased, being this under universal or singular title. Being the succession the transmission of legal relations in relation to the inheritance, the law calls to succeed the assets of the deceased person to the person who survives called testator. In Ecuador there are different ways for the heirs to succeed the assets of the deceased, which is granted by virtue of a will consigning the destination of their assets, called testamentary succession, as well as we have by virtue of what the Law determines called intestate succession, and the mixed succession by virtue of the fact that the assets of a person are granted by a will and another part determined by law, that is to say, a testamentary part and an intestate succession part. The present work will be based on the investigation of the order in which the heirs must succeed the assets of the deceased person and all the requirements that must be met for the acquisition of the rights and obligations to acquire ownership of the assets left, these assets may be granted through testamentary succession or in turn through what is determined by law or intestate succession as established by our Ecuadorian Civil Code, taking into consideration that the present investigation will be carried out based on information from books, magazines, web pages, documents and doctrine law regarding the issue raised. The methodologies used in this research work are qualitative and quantitative, since the facts and social phenomena that I will study in this work are measurable and quantifiable; so I also measured and established causal relationships between the variables, to explain the study problem and the current social reality. I applied the dogmatic and interpretative methods, because through these methods an answer to the problem treated is offered from what produces the best possible reconstruction allowed by the legal material that is available.
