Resumen :	En este trabajo investigativo titulado “Análisis del procedimiento legal establecido para la legalización de la concesión, uso y aprovechamiento de aguas en el sector rural” se realizará un detallado estudio acerca del procedimiento legal que se realiza hoy en día de acuerdo a la nueva reestructuración del Estado en el Ministerio de medio ambiente a través de su dependencia la Agencia de Regulación y Control del Agua que es la que actualmente se encarga de todo aquello que tiene que ver legalización de la concesión, uso y aprovechamiento de aguas en el sector rural. Un análisis desde la perspectiva del principio constitucional de equidad del procedimiento que se debe llevar a cabo para legalizar el uso, goce y aprovechamiento de las aguas para sembríos, abrevaderos de animales, piscicultura, etc.; actividades productivas que aportan a la economía local, provincial y nacional. Más sin embargo es inminente que hay diferencias entre los grandes, medianos y pequeños productores todos estos sectores con estricta necesidad de uso de aguas de ríos, vertientes naturales para poder realizar sus actividades de manera normal. Es necesario realizar un análisis técnico jurídico del respeto a la equidad en la concesión para el uso, goce y aprovechamiento de las aguas; es dentro de este ámbito que se analizará el procedimiento en el contexto de la normativa pertinente y como se lleva a cabo el procedimiento en la Agencia de Regulación y Control del Agua, porque se presentan continuamente casos que las grandes propiedades afectan a las más pequeñas y con ello se produce una afectación de acceder al recurso vital con equidad. Desde hace tiempos atrás se ha determinado que se legalice el uso, goce y aprovechamiento del agua como un mecanismo de regulación y control; pero este a más de estar normado, debe respetar condiciones, necesidades, fines de la productividad por lo tanto del uso del recurso vital; es desde aquí donde nace esta investigación que pretende determinar la idoneidad del procedimiento o a la vez determinar aspectos que se deben insertar para que el procedimiento de concesión, uso, goce y aprovechamiento de las aguas sea equitativo y este apegado al debido proceso. La metodología a utilizar en este trabajo investigativo es la cualitativa y cuantitativa, en virtud de que los hechos y fenómenos sociales que estudiaré en este trabajo son medibles y cuantificables; así también mediré y estableceré relaciones causales entre las variables, para explicar el problema de estudio y la realidad social actual. Aplicaré método dogmático e interpretativo, pues a través de estos métodos se ofrece una respuesta al problema tratado a partir de lo que cree la mejor reconstrucción posible permitida por el material jurídico que tiene a disposición. It is an analysis from the perspective of the constitutional principle of equity of the procedure that must be carried out to legalize the use, enjoyment and exploitation of water for crops, animal watering troughs, fish farming, etc.; productive activities that contribute to the local, provincial and national economy. However, it is evident that there are differences between large, medium and small producers, all these sectors have an implicit need to use water from rivers and natural springs to be able to carry out their activities in a normal way. It is necessary to carry out a technical-legal analysis about respect for equity in the concession for the use, enjoyment and exploitation of water; so it is within this scope that the procedure will be analyzed in the context of the pertinent regulations and how the procedure is carried out in the Water Regulation and Control Agency, because cases are continuously presented in which large properties affect the most small and with it there is an affectation to the right to access the vital resource with equity. For some time now, it has been determined that the use, enjoyment and exploitation of water should be legalized as a regulation and control mechanism; but this, in addition to being regulated, must respect conditions, needs, and purposes of productivity, of the use of the vital resource. This is where this investigation was born, which aims to determine the suitability of the procedure and at the same time determine aspects that must be inserted so that the procedure for concession, use, enjoyment and exploitation of water is equitable and is attached to due process. 5 The methodologies to be used in this investigative work are qualitative and quantitative, since the facts and social phenomena that I will study in this work are measurable and quantifiable. In this way, I will also measure and establish causal relationships between the variables, to explain the study problem and the current social reality. I will apply the dogmatic and interpretive methods, since through these methods an answer to the problem treated is offered from what it is believed to be the best possible reconstruction allowed by the legal material available.
