Resumen :	El propósito investigativo es analizar, mediante la hermenéutica y la comparación jurídica, la normativa de la Universidad Estatal de Bolívar (UEB) con respecto a los derechos de Propiedad Intelectual (PI) y sus mecanismos para garantizarlos. La orientación investigativa es mixta, apoyándose en lo cuantitativo en adición con lo cualitativo. En cuanto al alcance, es un estudio descriptivo, cuyo corte transversal se ubicó en el segundo y tercer trimestre del año 2022. El objeto de estudio es el Reglamento de Propiedad Intelectual de la UEB. Se aplica una encuesta que tuvo como población al estudiantado de la universidad Estatal de Bolívar carrera de Derecho, que se encuentran realizando investigación. Entre los principales resultados se obtiene que 24% de los estudiantes señala que sí ha recibido en la UEB algún taller, inducción o asignatura sobre derechos de propiedad intelectual. EL 76% no tiene conocimiento que la UEB tendrá una licencia gratuita, intransferible y no exclusiva para el uso no comercial de la obra por ellos creada. Se concluye que, con respecto a los derechos de autor, de propiedad industrial y obtenciones vegetales, la UEB cumple con la necesaria unificación de la legislación interna que regula la investigación institucional y su relación con la propiedad intelectual. Existe un marco para la generación de ingresos a la universidad, sin que haya pérdida de libertad académica, aunado al resguardo de los derechos de PI.
Descripción :	The research purpose consisted of analyzing, through hermeneutics and legal comparison, the regulations of the State University of Bolívar (UEB) regarding Intellectual Property (IP) rights and their mechanisms to guarantee them. The investigative orientation was mixed, relying on the quantitative in addition to the qualitative. Regarding the scope, it was a descriptive study, whose cross-section was located in the second and third quarters of the year 2022. The object of study was the UEB Intellectual Property Regulation. A survey was applied that had as a population the students of the university who were conducting research Among the main results it was obtained that 60% of the students indicated that they had received a workshop, induction or subject on intellectual property rights at the UEB . 74% were not aware that the UEB will have a free, non-transferable and non-exclusive license for the non-commercial use of the work created by them. It was concluded that, with respect to copyright, industrial property and plant varieties, the UEB complied with the necessary unification of internal legislation that regulates institutional research and its relationship with intellectual property. There is a framework for the generation of income for the university, without loss of academic freedom, coupled with the protection of IP rights.
