| dc.description | The post-mortem recognition of a de facto union has become a relevant issue within Ecuadorian inheritance law, particularly in the current social context. This legal mechanism allows the surviving partner to petition the court for a declaration recognizing the existence of the cohabitation relationship that existed prior to the death of their partner, with the purpose of obtaining inheritance rights that, under other circumstances, would correspond to a spouse in a legally recognized marriage. A de facto union is granted legal effects similar to those of marriage, provided that it meets the requirements established by law, namely stability, exclusivity, and permanence. However, when the union has not been legally recognized during the lifetime of one of the partners, its post-mortem recognition requires judicial proceedings. It should be noted that Ecuadorian legislation does not establish a specific procedure for this process, making it necessary to prove the existence of the relationship in order to exercise the rights derived from it. Once the de facto union has been legally recognized, the surviving partner acquires inheritance rights and becomes entitled to participate in the distribution of the deceased's estate. This means that the surviving partner may be recognized as an heir under the same legal conditions as other forced heirs, depending on the specific circumstances of each case. Nevertheless, such recognition may also give rise to disputes, particularly when children from different relationships or family groups challenge the legitimacy of the union. In resolving these cases, judges place significant emphasis on the evaluation of evidence, including witness testimony, documentary evidence, and any other elements demonstrating the existence of a stable, exclusive, and continuous cohabitation. Proper assessment of such evidence is essential to ensuring a fair judicial decision, as the absence of prior legal recognition places the surviving partner at a disadvantage and often requires the initiation of complex and time-consuming legal proceedings. The recognition of a post-mortem de facto union has a significant impact on the distribution of the deceased's estate, as it enables the surviving partner to participate in the succession process. Consequently, the inheritance shares of forced heirs may beaffected. However, the effectiveness of this legal recognition ultimately depends on the ability to prove the existence of the relationship before the judicial authorities, highlighting the need to strengthen legal certainty in this area of law. | |
