Abstract
Con este trabajo de investigación, se justifica el análisis jurídico sobre la acción de protección ante el uso progresivo de la fuerza por parte de la Policía Nacional, por lo que se analizaron bibliografías doctrinales y sentencias en materia penal, donde se demuestra que es de interés obtener mecanismos idóneos en cuanto a la aplicación de la ley.
En esta investigación hay capítulos dirigidos al uso progresivo de la fuerza, ponderación de derechos, garantías en respaldo a la Policía Nacional del Estado, los requisitos fundamentales para una legítima defensa.
El uso progresivo de la fuerza ampara el derecho a la seguridad ciudadana, por eso la Policía Nacional debe servir, proteger y garantizar el orden público, en referencia a los derechos humanos. Lo mencionado, son ideas fundamentales en esta investigación, cuyo objetivo es: Establecer el proceso jurídico de la acción de protección ante el uso progresivo de la fuerza por parte de la Policía Nacional del Ecuador.
La metodología de la presente investigación es de tipo cualitativo, insertando mecanismos como, el histórico-lógico y el inductivo, donde se analizarán las leyes que regulan los límites del uso progresivo de la fuerza en Ecuador, tales como: Carta Magna, Código Orgánico Integral Penal “COIP”, Código Orgánico de Entidades de Seguridad Ciudadana y Orden Público “COESCOP”, además la naciente promulgación de la Ley que normaliza el uso legítimo y excepcional de la fuerza Policial, Fuerzas Armadas y del Sistema Penitenciario.
La Constitución, como garantista de derechos, presenta como medios o estrategias las garantías constitucionales, por eso los ciudadanos están a su disposición a aplicar cuando corresponda, defender sus derechos constitucionales, ya sea frente a la autoridad, individuos o grupos sociales; sin esta garantía, los derechos de las personas no tendrían eficacia jurídica y se violentara los consagrados por nuestra Constitución.

Through the development of this investigative work, the legal analysis of the action of protection concerning the progressive use of force by members of the National Police is justified. This analysis involved studying doctrinal bibliographies and penal judgments, which demonstrate the significant interest in obtaining appropriate mechanisms for the application of the law.
Within this research, chapters can be found that focus on the content of the progressive use of force, the balancing of rights, the guarantees supporting the National Police by the State, and the fundamental requirements for legitimate self-defense.
The progressive use of force upholds the right to public safety; hence, the National Police has the obligation to serve, protect, and ensure public order, always respecting human rights. These aforementioned ideas are fundamental in this investigation, which aims to establish the action of protection regarding the progressive use of force by members of the National Police of Ecuador.
The methodology used in this research is qualitative, employing mechanisms such as the historical-logical and inductive approaches. It involves analyzing the laws that regulate the limits of the progressive use of force in Ecuador, such as the Constitution, the Comprehensive Organic Penal Code (COIP), the Organic Code of Entities of Citizen Security and Public Order (COESCOP), and also the recently promulgated Law that standardizes the legitimate and exceptional use of force by the Police, Armed Forces, and Penitentiary System.
The Constitution, as a guarantor of rights, provides constitutional guarantees as means or strategies. Citizens have the opportunity to apply these guarantees when necessary to defend their constitutional rights, whether against authorities, individuals, or

social groups. Without these guarantees, people's rights would lack legal efficacy, and the rights enshrined in our Constitution would be violated. Keywords: Progressive Use of Force, Action of Protection.
