| dc.description | This paper focuses on a flaw within Ecuadorian civil procedural law to examine a conflict that, far from being a mere technicality, directly impacts the administration of justice. The research topic is "Statutory incompatibility between Articles 48 and 294 of the Organic General Code of Processes (COGEP) vis-à-vis the right to adversarial proceedings, due process, and legal certainty in Guaranda, 2025." It constitutes an analysis of how two provisions within the same statute operate at cross-purposes when a third party attempts to intervene in ordinary proceedings. The identified problem lies in a procedural paradox that leaves litigants defenseless. On one hand, Article 48 of the COGEP grants a timeframe for filing third-party interventions (tercerías) that extends until after the trial hearing has been scheduled. On the other hand, Article 294 compels the judge to rule on the admissibility of these third-party intervenors precisely during the preliminary hearing, a procedural milestone that occurs much earlier. This statutory disconnect creates a major issue: if a third party appears within the timeframe allowed by Article 48, the proper procedural moment to cure the proceedings (saneamiento) and contest their evidence has already lapsed. In actual court practice, this translates into a procedural situation where the original parties are deprived of the time and forum necessary to oppose surprise claims, sacrificing legal certainty for the sake of an ill-designed principle of swiftness (celeridad). In light of this scenario, the general objective of this research is to analyze the legal impact of this statutory incompatibility on the protection of the fundamental rights of procedural subjects within the Guaranda canton. It determines the extent to which this lack of legislative coherence drives judges to hand down arbitrary interpretations that ultimately infringe upon the equality of arms and the right to a technical defense. To unravel this procedural entanglement, the methodology relied on a qualitative approach, oriented toward understanding the core of the problem beyond mere statistical figures. The analytic-synthetic method was applied to dissect the structure of third-party interventions and reconstruct their constitutional logic. Furthermore, the systemic-structural-functional method enabled the observation of the COGEP not as isolated provisions, but as an interconnected apparatus that currently fails in its function to guarantee justice. Finally, comparative law was utilized, contrasting the Ecuadorian reality with the models of Spain, Peru, and Argentina, with the aim of drawing insights that allow for the submission of an urgent statutory reform to restore predictability and respect for due process. | |
