Abstract
En Ecuador, el ganado tiene gran trascendencia e importancia social y económica, es por ello que la normativa ecuatoriana ha tipificado al abigeato al manifestarse como una conducta penalmente relevante, atentando gravemente un bien jurídico protegido por el Estado, la propiedad. Ante lo cual, el Código Orgánico Integral Penal para esta conducta determinado un delito y una contravención, dentro de los delitos y contravenciones contra el derecho a la propiedad.
Es por ello que la presente investigación se basará en el estudio de la del Código Orgánico Integral Penal, tras el estudio y valoración del comportamiento típico, sus elementos, el estudio de la parroquia San Vicente como una zona de mayor vulnerabilidad y todo lo que esta conducta punible de abigeato presenta.
Con el tema investigado se trata de determinar si se garantiza el derecho a la propiedad, la seguridad y protección pública que este derecho requiere.

Ecuador, cattle have great significance and social and economic importance, which is why Ecuadorian regulations have typified cattle rustling by manifesting itself as criminally relevant conduct, seriously violating a legal right protected by the State, property. In view of which, the Comprehensive Organic Criminal Code for this conduct determined a crime and a violation, within the crimes and violations against the right to property.
That is why the present investigation will be based on the study of the Comprehensive Organic Criminal Code, after the study and assessment of typical behavior, its elements, the study of the San Vicente parish as an area of greater vulnerability and everything that is related to it. punishable conduct of rustling presents.
With the subject investigated, it is about determining if the right to property, security and public protection that this right requires is guaranteed.
